1. Platform Role & Nature of Services
- Roamaya operates as a technology marketplace that connects Travelers with independent Hosts and Planners who organize trip experiences.
- Roamaya is NOT a tour operator, travel agency, transport carrier, or hospitality provider.
- We do not own, operate, manage, or control the trips listed on our Platform.
- The relationship for trip delivery exists directly between the Traveler and the Host/Planner.
- Roamaya's role is limited to: facilitating discovery, processing bookings and payments, enabling communication, and providing dispute mediation.
2. No Guarantee of Trip Quality
- While we verify Host identities through KYC and moderate trip listings, we cannot guarantee the quality, accuracy, safety, or legality of any trip experience.
- Trip descriptions, images, and details are provided by Hosts. Roamaya is not responsible for any discrepancies between the listing and the actual experience.
- User reviews and ratings reflect individual opinions and may not represent your experience.
3. Assumption of Risk
By booking and participating in trips through Roamaya, you acknowledge that:
- Travel inherently involves risks including but not limited to: physical injury, accidents, illness, adverse weather, natural disasters, theft, and loss of property.
- Adventure and outdoor activities (trekking, camping, water sports, wildlife encounters) carry additional inherent risks that cannot be fully eliminated.
- You voluntarily assume these risks when you choose to participate.
- You are responsible for assessing your own physical fitness, health conditions, and suitability for the trip you book.
- You should carry appropriate travel insurance, medical insurance, and personal accident coverage.
4. Limitation of Liability
- Roamaya, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Platform or participation in trips.
- This includes but is not limited to: personal injury, death, property damage, financial loss, data loss, or emotional distress.
- Our maximum aggregate liability for any claim shall not exceed the platform commission actually received by Roamaya for the relevant booking.
- This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).
5. Third-Party Services
- The Platform integrates with third-party services (Razorpay for payments, Cloudinary for images, Google for authentication). We are not responsible for the availability, accuracy, or security practices of these services.
- Links to external websites or resources (Host social media, external booking links) are provided for convenience. We do not endorse or control their content.
- Your interactions with third-party services are governed by their respective terms and privacy policies.
6. Content Accuracy
- Information on the Platform (trip details, pricing, availability, dates) is provided "as is" and may contain errors or become outdated.
- Prices and availability are subject to change without notice until a booking is confirmed.
- We make reasonable efforts to keep information accurate but do not warrant completeness or timeliness.
- Photographs may not perfectly represent actual conditions (seasonal variations, weather, renovations).
7. Health & Safety
- Roamaya does not provide medical advice. Travelers should consult healthcare professionals before undertaking trips, especially those involving altitude, strenuous activity, or remote areas.
- You are responsible for informing your Host of any medical conditions, allergies, or special requirements that may affect your safety.
- Roamaya is not responsible for the Host's safety standards, equipment quality, or emergency preparedness.
8. Force Majeure
Roamaya shall not be liable for any failure or delay in performance resulting from circumstances beyond reasonable control, including but not limited to: natural disasters, pandemics, epidemics, government actions, civil unrest, war, terrorism, strikes, infrastructure failures, or internet/telecommunications outages.
9. Insurance Recommendation
Roamaya strongly recommends that all Travelers purchase appropriate insurance before embarking on any trip, including:
- Travel insurance covering trip cancellation and interruption.
- Personal accident insurance.
- Medical/health insurance with emergency evacuation coverage.
- Baggage and personal belongings insurance.
Roamaya does not provide, sell, or endorse any specific insurance product.
10. No Professional Advice
Content on the Platform (blog posts, trip descriptions, destination guides) is for informational purposes only and does not constitute professional travel advice, medical advice, legal advice, or financial advice.
11. Intellectual Property
- All Platform content (design, code, brand elements, logos) is the intellectual property of Roamaya unless otherwise stated.
- User-generated content (reviews, images) remains the property of the respective user, with a license granted to Roamaya for platform use.
- Unauthorized reproduction, distribution, or commercial use of Platform content is prohibited.
12. Governing Law
This Disclaimer is governed by the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
13. Severability
If any part of this Disclaimer is found to be unenforceable, the remaining provisions shall continue in full force and effect.
